Litigation lawyer
We are looking a litigation lawyer who is looking to focus on insolvency and restructuring law and civil litigation. There is the ability to develop a practice in a complimentary area of law.
The position offers:
1. Fee Split or Salary -
(a) As a contractor - Generous fee-split compensation structure (sliding scale based on collected billings from 45% up to 65%); OR
(b) As an employee - base salary of $80,000 to $120,000 depending on year of call and relevant experience (with bonus based on exceeding targets)
2. Reasonable targets: 1,400 billable hours per year
3. Opportunities to develop specialized practice areas related to bankruptcy and insolvency law and litigation
4. A mix of independent file management and collaboration on larger matters. Lawyers are expected to be able to work independently on smaller or less complex files
5. Access to opportunities mentorship and support to develop as a litigation and insolvency lawyer
What sort of work will I be doing?
Bankruptcy & Restructuring: Representing individuals, small and medium-sized businesses, and trustees in bankruptcy in matters ranging from personal bankruptcy proceedings to corporate restructuring. We are currently growing our commercial restructuring practice often advising debtor companies, directors and creditors in these proceedings.
- For small and medium-sized businesses, we often assist management and directors in making arrangements with creditors such as negotiating forbearance agreements, out of court workouts, advising on the liquidation and sales of businesses assets in distressed situations or restructuring
- Working for creditors, debtors or others on Division I proposals or bankruptcies for businesses
- Advise business owners on directors’ liability resulting from banks, landlords, employees, and CRA and on resolving these liabilities.
- Having conduct of less complicated personal bankruptcy files: student loan hardship applications, discharges from bankruptcy, consulting with debtors and trustees in relation to estate administration issues
- Advising individuals, business owners and businesses on tax debts, including in insolvency proceedings or outside of insolvency proceedings
- Junioring or conduct of less complicated aspects of foreclosure and receivership proceedings
- Advising or representing individuals or trustees on realization proceedings including fraudulent conveyance proceedings, or transfers at undervalue
Commercial Litigation: Our commercial disputes go hand-in-glove with the insolvency practice. Often these involve banking disputes, debtor-creditor disputes, civil fraud claims, personal guarantee and directors liability litigation.
Estate Litigation: A growing practice area, including wills variation, estate administration, executor disputes, and insolvent estates. We often handle files involving estate administration, wills variation claims (acting for defendants rather than plaintiffs), and dealing with debts and insolvency in estate matters.
We use a modern tech suite to make life easier for our litigators: Netdocuments, Soluno, ACL5, Citrix desktops, etc.
We also offer three weeks paid vacation (15 paid days off) and a $2,000 annual Health Spending account.
